U.S.%20State%20Map%20Virginia.jpgIn Richmond, Virginia, Keishawn L. Whitfield, age 23, was recently convicted on charges of Involuntary Manslaughter and Child Neglect. In the Summer of 2009, Mr. Whitfield left a 13 month old child unattended in a day care center van. Whitfield’s attorneys argued that it was a mistake and inattention rather than a crime to leave the child in the day care center van. Tragically, the child died as a result of being left in a hot vehicle in the Virginia summer heat. The child was enrolled in the Yellow Brick Road Day Care and Learning Center which was owned and operated by Whitfield’s mother.

In Connecticut and other States, parents rely on babysitters to watch, supervise, and care for their children. Some babysitters are experienced and very caring while others put their own interests in place of the child’s. In Bridgeport, Connecticut, a babysitter was arrested after a baby was treated at a hospital for severe head injuries. Police believe that the babysitter (Keamira Fatal – age 24) banged the baby’s head on the floor several times after the 1 year old girl disturbed the babysitter who was watching television. The babysitter reported that the baby was crying and that the babysitter did not quite know how the baby was injured. In a criminal investigation and case of this nature, forensic and medical evidence will play an important part in determining what truly happened to this defenseless child. This is especially true since the victim cannot state what happened to her and there were no witnesses at the time the injuries took place. education%20day%20care%20school%20green%20back%20pack.jpgIn Cupertino, California, a 5 year old child was run over by a teacher. Tragically, the 5 year old died. It was later determined that the day care center, Elite Chinese School, did not have a day care license. Elite has a business license but did not have the separate California day care license. As such, the State of California never inspected the facility or its grounds for safety or compliance with the applicable day care center guidelines and regulations. The accident at issue is also under investigation.

Education%20Day%20Care%20Building%20Block%20G.jpgIn Paducah, Kentucky, a day care director has been charged with a crime for leaving a three year old boy on the day care center van. WPSD-TV reported that Tanashea Young was charged with the crime after she took the van to a repair shop for repairs. The child was left on the van and was later found after the van was lowered from the rack or lift where it was being repaired. Ms. Young reported that she knew that the child was still in the van. This really did not make sense in that the child was left in the van while it was placed up on a lift. What parent or diligent day care director would put the child in such a position?

In New York and other States, day care operators have a duty to provide for the health, safety and welfare of children. It is well known that small children are at risks for choking on certain food items like carrots, grapes, and hard candy. Children are also at risks for choking on change, small toys, and other common items. A day care owner should take precautions to keep choking hazards away from small children cared for in the facility. In New York, a lawsuit was recently filed by a family regarding the death of a two year old who choked on a carrot. According to a story posted in Newsday.Com, the day care center (Carousel Day Care Center) located in Hicksville, New York frequently gave children carrots to eat the day care center. This dangerous practice led the the choking death of a 2 year old child.

According to CBS News, Tito Ruiz was found guilty of the crimes. The criminal investigation and trial revealed allegations by two girls who reported that they were touched by Mr. Ruiz while at the day care center. All of the details of the trial were not reported. In Wilmington, Delware, a 19 month old boy wandered away from a day care center. He was found crawling on a sidewalk near a busy intersection. In Delaware and other States, there is a problem with day care supervision of children. Fortunately, ths child did not suffer any serious child personal injuries. The fact that the child was not injured does not excuse the failure to supervise and the failure to have safety precautions in place to prevent this incident from taking place. It was reported that a parent may have left a gate open. Since parents are not trained in day care supervision or facility safety, it is the responsibility of the day care operators and staff members to make sure that safety precautions are in place that account for acts that a parent may take while at the day care facility. In Grand Prairie, Texas, there was a serious van accident that involved personal injuries to 13 children on the van. Further investigation of this incident revealed that the day care center driver did not even have a valid driver’s license. Day care operators in Texas and other States have a duty to complete background screenings which includes a check of an employee’s driver’s license for those employees who will be transporting children. In East Orange, New Jersey, a father stashed or stored a bag of cocaine in his son’s clothing. The boy went to a day care center and thought that the cocaine was candy and gave it to three other children in the day care center. Since the boy was only four years old, there is certainly no wrong doing on the part of the boy who innocently believed that the cocaine was candy or food. Typically, day care centers do not search through a child’s pocket or back pack upon entry to the day care center. While this is not required, it may be a good practice to follow with the consent of the parents who enroll their children at the day care center. Children often times bring other objects into school like coins, small toys, and other items. Small children are at risk for poisoning and choking incidents. As such, all possible and practical safety measures should be utilized by the day care center as well as parents who send their children to the day care center. The father, who stored the cocaine in his son’s clothes, was not only negligent. He was also guilty of a crime for doing so. Of course, the father will be entitled to a defense on these charges. Regardless of the outcome of the criminal case, this incident shows the dangers of children bringing drugs, poisons, and other items into day care centers that can harm or cause the choking of children. A Vacaville, California day care provider has been arrested in connection with allegations that she injured or harmed a child under her care at an in home day care center. Chris Edwards (age 52) was charged and arrested for corporal injury to a child. An investigation by local police and the State of California Community Care Licensing division determined that the facial injury to the child resulted from corporal punishment or disciplinary measures by this child care provider.
