What are the Legal Rights of the Child Hit, Punched or Abused in a Day Care Center or School?

In Connecticut and other States, day care centers, schools, and summer camps should be safe havens for children. Unfortunately, at these very locations, children are subject to abuse, neglect, and corporal punishment. Let’s face it. Children, at times, will misbehave and fail to follow instructions. However, this is no reason for hitting or striking a child in a day care, school, or summer camp setting. In fact, there are no good reasons to justify the abuse, neglect, corporal punishment, or exploitation of a child. When a child is abused or neglected in a child care setting, there may be one or more legal proceedings that result from the alleged bad conduct of the day care provider. There may be an arrest or criminal prosecution in the form a criminal case. There may be a fine levied against the day care center or a suspension of the license in the form of an administrative procedure. There may also be a civil case or claim against the individual day care center provider and / or business for the injuries / damages suffered by the child. It should be noted that the pursuit of any one of the three types of cases are not dependent on each other. For instance, a civil case or claim can be pursued even if there are no criminal charges filed.

The Senseless Deaths of 20 Children in Connecticut Elementary School – What Lessons (if any) Can Be Learned?

Tragically, Sandy Hook Elementary School was recently the site of one of the deadliest and senseless school shootings in U.S. history. It has been reported that 20 children and 6 adults were murdered at the school. See Shooting Reported at Connecticut Elementary School.
The lone gunman then apparently turned the gun on himself and also died at the school. The school’s principal and psychologist were listed as two of the casualties of this horrendous and unforgiven act of violence at these innocent children. It is a shame that the lives of innocent children as well as our valued educators and leaders were taken. In the aftermath of this horrific act of violence, what can be learned about the shootings? As a community and nation, are there lessons to be learned in any manner? There certainly will be more questions than answers to this disaster. Why does history (in one form or another) repeat itself? Just the word “Columbine” strikes a tone of sadness and grief for the parents and family members who lost loved ones during that massacre perpetrated by two students.

In Connecticut and other States, children are enrolled in day care centers to allow their parents to work their jobs. Many day care centers are well run and do a wonderful job of supervising and caring for the children in the day care center program. Unfortunately, at times, children are the victims of poor care, inadequate supervision, and, in some cases, abuse and neglect by the very same day care center providers who are responsible for their care. Connecticut Lawmakers Vote to Ban Smoking in Connecticut Day Care Centers

The Connecticut State Senate recently voted to ban smoking in Connecticut Day Care Centers. The bill passed by a lopsided vote of 35 to 0. This bill makes sense in that smoking has no place in a day care center or around small children. If a person cannot follow such regulation due to a bad smoking habit, that person should find another job or career. Connecticut – Convicted Sex Offender Had Thousands of Child Pornographic Images on Computer

In Connecticut, police arrested a convicted sex offender for having child pornography including photographs and images on a computer. Due to the large number of images located (20,000 – Twenty Thousand), it appears unlikely that the images were accidentally downloaded or mistakenly placed on the computers. Of course, the criminal defendant (Charles Heaton – age 60) in this case will be entitled to the services of a public defender or a private criminal defense attorney.
Minivan Crashes into Day Care Center – Stamford, Connecticut

In Connecticut and other states, parents take their children to day care centers with the expectation that their children will be safe. Unfortunately, incidents and accidents happen in day care centers in Connecticut that cause personal injuries to children or put them at risk. In Stamford, Connecticut, it was reported that the driver of a minivan mistakenly crashed her vehicle into the day care center. Apparently, she mistook the gas / acceleration pedal for the brake at the time of the incident. Fortunately, there were no personal injuries reported from this incident. This is not an isolated event as there have been other incidents or reports of vehicles crashing into day care centers as a result of negligent driving or the negligent driver of another vehicle.

Babysitter Charged with Attempted Murder and Risk of Injury to a Child in Bridgeport, Connecticut

In Connecticut and other States, parents rely on babysitters to watch, supervise, and care for their children. Some babysitters are experienced and very caring while others put their own interests in place of the child’s. In Bridgeport, Connecticut, a babysitter was arrested after a baby was treated at a hospital for severe head injuries. Police believe that the babysitter (Keamira Fatal – age 24) banged the baby’s head on the floor several times after the 1 year old girl disturbed the babysitter who was watching television. The babysitter reported that the baby was crying and that the babysitter did not quite know how the baby was injured. In a criminal investigation and case of this nature, forensic and medical evidence will play an important part in determining what truly happened to this defenseless child. This is especially true since the victim cannot state what happened to her and there were no witnesses at the time the injuries took place.
