SALT LAKE CITY — A man who ran a day care center with his wife for 20 years has been arrested and accused of molesting at least two of the girls he was tending.

Police say they have identified additional victims and fear there may be even more.

Gordon Neeley, 76, was booked into the Salt Lake County Jail for investigation of four counts of aggravated sexual abuse of a child.

While it is appropriate to punish punish or discipline a child for bad behavior, it is important for parents and caregivers to recognize and understand that physical forms of punishment can lead to serious personal injuries in some instances the unfortunate and tragic death of a child. It was recently reported that a child died as a result of complications from dehydration relating to punishment that was given to the child for eating a candy bar. The child was forced to run for a three hour time period until the child eventually collapsed from exhaustion and dehydration. Of course, the women, who were arrested, will be entitled to representation from a criminal defense attorney or the public defender’s office. Cases of this nature will depend on the facts, circumstances, witness statements, and the forensic evidence including the child’s medical records and autopsy and laboratory results.

Among the various laws and regulations are those that are related to corporal punishment and discipline of children in day care centers and child care centers. Under Kansas law, a day care center / child care center is prohibited from implementing corporal punishment against a child. This is a good law that should stay on the books. Unfortunately, other States have laws in place that allow corporal punishment even against day care center aged children. Corporal Punishment should be prohibited conduct in every day care center. Even in States in which corporal punishment is allowed or permitted under State Law, day care centers and child care centers should avoid using this form of punishment / discipline as it can lead to serious physical and emotional injuries to children. Furthermore, many child care providers are not well trained in safe methods of corporal punishment and often times exceed what is allowed or legal in States in which corporal punishment is permitted. If a child suffers an injury requiring some form of medical care, there is a strong likelihood that the corporal punishment was excessive. This, in turn, may lead to criminal and / or civil proceedings against the day care center and the employee.

State%20Map%20Pennsylvania.jpgIn Northview Heights, Pennsylvania, a tragic death of a 4 year old girl – Shaniya Darby-Sims – was recently reported. A television set weighing approximately 60 pounds fell off of a dresser and onto the 4 year old year old. The mother – Shamika Darby – found her daughter upstairs and removed the television set off of her and then started CPR. The child was later rushed to Children’s Hospital where she later died. Children should be supervised in a caring involvement free from abuse and neglect. Unfortunately, many children are injured in Ohio day care centers due to negligence and some due to the intentional acts of day care workers. Corporal Punishment is a form of discipline used by some child care providers. Physical and emotional acts of discipline can have a lasting effect on a child. Any time that there are slow moving vehicles present – other drivers should slow down and do their best to give some room and deference to these other vehicles. Whether it is a horse drawn carrier, bicycle, cart, or other object on wheels, it is the best practice to slow down and give room to these vehicles that are travelling on or near the roadway. An otherwise peaceful day turned to tragedy and suffering when this Federal Express truck and Amish buggy collided.

It is interesting that some fights or brawls in o near schools are well known to many children during the day and prior to the fight. Unfortunately, in many instances, nobody steps forward to report the planned fight to school officials. Furtheremore, when the fight starts, many students prevent others from breaking up and / or ending the fight. A tragic death was recently reported in Long Beach, California. It was reported that a 10 year old girl – Joanna Ramos – died from a head injury that she sustained in a fight with a classmate who was 11 years old. Joanna suffered a blood clot as a result of the fight which in turn caused her death. It is most unfortunate that the death occured and that medical care was not provided in a timely manner.
